Thanks for looking at this post. I think one of our newest members, JPalsey is returning home from his duty in Iraq. From what I have learned, he has spent quite some time on this web-site learning about Mark VIII's. He even purchased one while in Iraq, and the car patiently awaits his return back here in the states.

I for one, welcome him home and wish to show my appreciation for his courage, and hard work. We all have seen it in the movies, and some of us have even lived through it, but being in the military is not easy. It requires not only physical strength, but emotional strength as well.

I just want to say to JPalsey, who I think ships out via Germany today or tomorrow.... welcome home soldier. You make me proud. Thank you for all you have done.... and the blue banner that runs across this webpage... is for people like you. Now go get in that Lincoln and take it for a drive... even without starting the motor. Just sit in it. Feel the freedom of being behind the wheel of something that symbolizes the very reason you were away from us for so long. You made it. Cherrish this moment.

I'm only sorry that I couldn't arrange for some special treatment for JP. My bud the airline pilot has been in simulator training stateside, then flew a couple of trips to Paris, so it didn't matter anyway.

As an Air Force vet of the early-70's, my hat's off to JP as well. Well done, brother. It's just too God-damned bad that the lamestream media refuses to report all of the good things you've helped to bring about in Iraq. Pay no attention to those people behind the curtain.

   Thanks everybody:
I'm really short on words. I'm glad to be out of there because of all the bombs and IED and rockets that are still going off all around the soldiers everyday, and I extend your thanks and thought to all the soldier in hostal envorments everywhere. I'm in Germany which was my home station that I'm leaving. and I well be going to Fortsill, Oklahoma.

   I havn't been able to get online to check the board because of outprocessing for my PCS. but I'm well be in the USA on the 30 of December.
My car still isn't home I had a problem with the first transport company that I tried to use they keep on saying that we would pickup my car anyday and that ended up never happeing but they don't want refund my deposit. I had to contact the BBB and i'm going to see what they say. To bad I didn't check with them before I hired this compnay because they already had a bad rating with the BBB (Better busness Bueru)
The other compnay although $200.00 more expensive then the first already pick up my car and it on it's way I hope

   Maybe you should list the name and phone number of that shipping company. After what you have been through for our country, I am willing to bet quite a bit of this site's 5000+ members is willing to assist YOU in your personal battle!!!(count me in as an army of 1!)Post their name/phone number, and we'll see what we can do on your behalf. (if not getting the car delivered, hopefully your money back)

I dont understand what's wrong with this country. A kid goes off to war, and someone on his own team screws him behind his back. There should be a stiffer penalty than usual for messing with those who protect our borders! Thats like kicking your own guard dog.

   Good news Bad News
I made it to my Home of Record on the 30th. But my car still hasn't made it here. I never thought it would be so hard to get a car from MA to OK.
I Have to give this new company some more time before I get unreasonable. I hired them on the 15th of December and they told me 8-12 days. I figure business days. They did pick up from the start point on the 16th . When I talked to them they said that they didn’t have a carrier going this way. I figure it was because of the holidays. They hve a good rating from the BBB.

No way that this old marine can tell you just how much all of us appreciate what you and your fellow soldiers and marines have/are doing/done.

Count me in, DOM. Johnell - a couple of questions for you:

1. How much was the deposit with the first company?

2. How did you pay the deposit (check, money order, credit card)?

3. Did you have a written agreement with the first company?

I suggest that you call the Oklahoma State Attorney General's office, and explain your problem with the deposit. If they can't help you (but I'll bet they can), they will be able to refer you to the regulatory agency that can - perhaps the DOT/ICC. You'll have some other legal options as well.

   I called Auto Shipping Co. this am, identified myself { I don't make anonymous calls} and asked them to comment.

The woman I was talking with apparently had received othe calls, as she immediately went on the defensive with me and tried to say it was all Jonell's fault.

Said she couldn't refund deposit because of all phone calls, etc. they had to make.

I asked why they were in dutch with BBB, she said because of people's false accusations on them.

In closing, I told her I didn't think she would get any more business from the lincoln site. She replied "Thay's fine, they're big and hard to load anyway".

We need a bunch more calls.

   Well, I just composed one of my masterpieces, and sent it via email to the company. Now I will see what happens. If I dont get a response by Monday 9:00am, my good friend Michael Finney at the local news station will get a phone call. J.P.... hang in their bud... we're trying!

Hello and thank you for your trouble.

To answer your questions;
The deposit was $145.00.
The Company received a Check and cashed the check on the 9th of November.
There was a written agreement with the company. also a lot of broken promises.

It really feels good to know that you have strong people behind you to give you a hand when you need one.

And as for calls I Told her that I need the car pick up because the car lot I got the car from was going to start charging storage fee. and she said that she would call them and talk to them. She told them that she would pick the car up within the week and never picked the car up.

I was hoping that you had used a credit card for the deposit, which would have made it quicker and easier for you to get at least most of your deposit back. Since the bad guys are located in another state, I suggest (again) that you contact the OK State Attorney General's office to see what they can do for you.

If the company violated any term(s) of the written agreement, then you have a case for a lawsuit in small claims court, which you would file in the county where you live in OK. This is very easy to do, and you do not need to retain an attorney. There will, however, be a small filing fee and some expense involved in serving the summons to the company in California; however, you can add any and all of these expenses to the amount of damages you seek from the company. In all honesty, what will happen if you do this is that no one from the transport company will appear in court, and therefore you will win by what is known as a summary judgement. However, it will be very difficult, if not impossible for you to actually collect from them.

Call the AG's office on Monday, then let me know what they say. If they can't help you, I'll offer some advice on what you should do next.

   I'll call the company on Monday and tell them it's getting around to a lot of message boards, and ask for them to email their side of the story so they can get equal time. That would be a good opportunity for them to realize they are going to get about 800 phone calls on this matter and that losing just one job as a result of this will be a net loss for thier company... let alone a whole day of answering the phone.

Maybe Blown306 and/or some others around here can help get the TCCOA boys on the band wagon. Might not do any good though - The Auto Shipping Company probably thinks they're "big and hard to load" as well. I just hate it when companies hold current and potential customers in contempt.

Yesterday, I sent a short-but-sweet email to The Auto Shipping Company, and received a prompt reply from the owner. I told him that in the interest of fairness I would post what he said here, and here it is:

"I have received phone calls and letters from members of your club. I would like to let you know that I have done 100's of service men and womens' cars for nearly my cost because of their service for our freedom. Because of this one move that had circumstances that are not mentioned in Mr. Pasley's letter, I have become a very bad person.

Mr. Pasley states that he could not reach my e-mail because I had blocked him. For the record, I do not even know how to block an e-mail address. I was in contact with his mother almost on a daily basis (again which he does not mention).

Because of the nature of our business we do not guarantee delivery or pick up dates and this was explained verbally and in writing to him before he placed the order with us. Also, he was moving the car during the holidays which is a little slower than usual. We also had weather back east at this time.

I am not making excuses, but there is more than one side to this story and it seems before someone starts blaming, judging and condemning they should give the other side a chance.

It by the way was never stated that a refund would not be given. I personally told him to send a cancellation letter (which we need with a signature) to receive a refund. To date, no letter has been received."

Well, I think the guy is right, and now we have his side of the story. Johnell - one of two things must be true. Either you misunderstood the company's position (contracts can be confusing and/or complicated), or, they're changing their tune due to all of the heat and adverse publicity they're getting from the good folks here. I, for one, suggest that we give them the benefit of the doubt, and the opportunity to do the right thing. Send them the cancellation letter with your signature (which is a reasonable request from a legal standpoint), and be sure to include the date of the original agreement, the contract number (if there is one), and state specifically that you want your deposit refunded to you. If it were me, I would send the letter by certified or registered mail with signature confirmation. Keep us posted.

   Good work Gale155, so looks as if they are ready to settle this. I personally believe that our calls ans e-mails did the trick.

My belief is based on the point that the woman I talked with used the same points and excuses as were related to you by the owner. But this woman was adament in that they had spent too much time, and too many phone calls had been made by them to refund a deposit. NO mention was made of a written cancellation letter.

I tend to agree with you, DOM. It would have been quite easy for her to have told you that Johnell had failed to send the letter, which again, is not an unreasonable request on their part. Phone calls are more effective than emails, so you and the others who actually made those calls probably got their attention.

It is possible, I suppose, that the right hand (the person you spoke with) doesn't know what the left hand (the person who emailed me) is doing. However, I tend to doubt this as well, because in my email I alluded to the fact that Johnell's tale of woe might "spread" to the TCCOA, as well as various Mustang clubs. I asked if he thought those cars were "big and difficult to load" as well (that comment really irked me). As you can see, there was absolutely no reference to that question in the reply I received. If he didn't know about your conversation with the lady, one would think he would have asked me what the heck I was talking about.

Well, here's my update. I emailed the company on Saturday. I have not received a response. I then proceeded to post a similar thread on a well known Mark8 message board, trying to see if I could stir some interest in this matter. As many of you know, I visit both sites regularly, as I have quite a few aquaintances there as well.

I think that was a mistake. For some reason, my post wasnt exactly "welcome" on that board. For the sake of avoiding a controversy, I will simply say that I spent quite alot of time defending my request on the other board. It seemed that the words I chose to write in my post were completely misunderstood, and people thought I was begging that they either raise money to help Mr. Pasley recover his losses, or I would think they were cold and heartless. For the record, I used the same words I had written here. I dont think any of you thought we were on a fund-raiser here. We were simply trying to do what we could to help rectify Mr. Pasley's situation.

I regret that I cannot go into much detail about exactly what went down on the other site, but I assure you, I wasnt very popular for several hours. I was finally able to get my point through, and no one has written anything since.

I wrote an apology to anyone I may have offended(shrugs), and left matters the way they lay.

I am just very happy that all of you who have applied your efforts on Mr. Pasley's behalf have lived up to the type of people I thought you all were. Caring, un-selfish, generous, and dedicated to being helpful to people. Unfortunately, that didnt happen on the other site. Again, let me make it clear, I may have chosen words that many didnt understand.(shrugs even bigger).

Lesson learned. Home is where the heart is.... I am home. But I did learn something very valuable over there: I now know where to buy a decal kit to make my refridgerator look like a tool box!

Please post any advancements in this situation Mr. Pasley, so I can update the other site. There were a few who expressed concern. Just a few though. I would like to cater to those who showed kindness.

   The story my side.
I got my car off Ebay on the 26 October 2003, I then started looking for a shipping company to ship my car at the lowest price I could find.
On the 4th of November I received an email from The Auto shipping Company asking that I call them. Because of my location I sent the information thru Email. I explained that I was in Baghdad Iraq, and that I would not be in country until the 02 January 03. All I needed was a date that my car was going to be picked up so that I could make arrangements with the company that had my car at the time so I could pay the storage cost for the period of time the car was there.

I was told that the car would be made available the week of the 24th of November. I saw that that was Thanksgiving weekend so I gave it until the after Thanksgiving.
I sent emails asking for the progress and didn't get a response, two emails came back unanswered, so I had my mother call and talk to her. I even called from Baghdad and had the Auto Shipping Company call the company that had the car. She told him she would have the car picked up within the week, another broken promise. And the car was still not picked up. I left Baghdad, Iraq and went to Friedberg, Germany on the 02 of December and I called The Auto shipping company on the 4th, 8th, 11th, 12th, 15th and got the status updates as follows "The Truck is in the area and will pickup your car in the next two days, There was a storm in the area and everything is behind. The truck is in the area and will pickup your car anyway." on the 12th I was given the number to her dispatcher who told me that they where having trouble finding a truck going in the direction that my car was going.
I asked for a date of pickup and she could not give me a date but told me that I could cancel my order and find someone else to ship my car. I got off the phone with this lady and called The Auto Shipping Company back and she told me that she would not refund me any money. On the 15th I called she had no good news so I found another company to ship my car.

Note: I didn’t even realize that I was not the only person that has had a similar complaint about this company. After all of this I found there Name on WWW.BBB.ORG and then this Post led me to the rip-off sight where there name is posted up again.
I think that she has had a change of heart about refunding my money because of the mass force that this message board has. “The only other person that has felt this force is Saddam “.
I well say that after the rude way she told me that she would not refund my money on the phone I didn’t send her a written request to refund my deposit. Again because she told me on the phone that she was NOT going to refund my money.
I am thanking every member of this board for your strong support in this matter regardless of the outcome. I don’t want be negative towards anybody but this is not a company that I would recommend to anyone.

Note: Thank You all again. And I was surprised as to how the member responded from my message.

When I was told on the Phone that I was not going to get my deposit back. I didn't think that writing a letter would have done anygood. I reread the post from The Auto Shipping Company said that they told me to send in a written letter asking for a refund. and that never has happend. They never told me to send in a written signed letter for a refund I was told that we don't give refunds on deposits. I never have talked to a male so I guess someone more reasonable is getting involved in this now. If I receive my refund for my deposit I well be the first to let everyone here, the BBB and ripoff.com know that this may have been a huge missunderstanding.

And I also don't think that they would have looked at my letter requesting a refund without the influnce of this board.
In the morning I'm sending my letter for return with return receipt requested.

The only thing I can tell you, Johnell, is that the person I have been in contact with via email (who I assume is the owner) has been nothing but understanding and reasonable. When I got the email from him (which I posted here), I replied, promising that I would make his side of the story known - which I did. I've received a timely response to that email, and here it is:

"Thank you for looking at both sides of the story. I have thought long and hard about this. Since I have gotten quite a bit of feed back from your group, and I believe that numbers count, I have decided to return Mr. Pasley 's deposit. I am a fair person and belive that this is the right thing to do.

I want to thank you for taking the time to read and understand my side of the story. Because of your kindness and understanding I do want to make a refund to him."

I don't normally like to reveal private emails, but in this case I don't think they'll mind. Were they trying to screw you, and did an about-face because of the heat they got from here? Or, was your case simply a misunderstanding? I don't know, of course. If this guy has indeed provided discounted services to hundreds of military personnel (as he claims), he can't be all that bad. If you want my personal opinion, it sounds to me like he needs to replace the beeoch that handles the phone calls.

   When I started this thread, it was with the intention of welcoming home one of our brothers. J Pasley was half way around the world, while we were taking pictures of our cars.

I wanted to wish him a happy, and safe homecoming. I am very touched by the out pouring of support and open hearted kindness you have all expressed.

I had no idea this would turn into a rally of our forces to assist our brother in his time of need.

Mr. Pasley, you shouldered your weapon, loaded up your gear, and headed out into battle to defend the world against terrorism. For that, we are forever greatful. When you came home to us, you were left fighting a force beyond your weapons scope, and beyond your field of vision.

I cannot express how thrilled I am that this situation appears to be resolved... successfully. I want to say thanks to all of the members who came to Mr. Pasley's aid, and took this on as a personal goal to help him. You have all done a wonderful job.

This whole thread serves as a reminder of how people can come together to help a fellow citizen who has been wronged.

I know the personal struggle I went through behind the scenes with Private messages, warnings, and just uglyness on "the other site" on the behalf of Mr. Pasley was all worth it.
Just to prove a point, I posted Gale's last post on the other site(names withheld of course) just to prove a personal point. People do care!

J Pasley, please be sure to tell us all when your refund is in your hand. Then we can lock this thread in the archives, and celebrate a victory.

Bless you everyone. I am proud to know you all..... and to think this all started... over a car.
